Clear expectations for every session

1. Eligibility and account security

You must be legally able to enter into contracts in your jurisdiction to use the service. Keep your login credentials confidential and ensure your team uses unique, strong passwords. Notify us immediately if you suspect unauthorized access to your account.

You are solely responsible for the security of your environment. Planning Poker is not responsible for leaks or disclosures resulting from private or protected information being shared in an unsecured or insecure session under your control.

2. Acceptable use

• Be respectful Collaborate responsibly. Do not harass, threaten, or otherwise misuse the service to harm others.
• Stay lawful Only upload or share content that you have the right to use, and comply with all applicable laws and regulations.
• Protect access Do not attempt to probe, scan, or breach any security or authentication measures. Do not reverse-engineer the service without written permission.

3. Service features and availability

We continually improve Planning Poker and may add, change, or remove features at any time. We aim for high availability, but the service may occasionally be unavailable due to maintenance or circumstances beyond our control. We will provide advance notice of material changes whenever practicable.

4. Customer responsibilities

• Data stewardship You control the information entered into a session. Export or document anything you need before a session is marked inactive and restricted to moderator-only access.
• Compliance Ensure that your use of the service complies with your internal policies, contractual obligations, and any industry-specific requirements.
• Team coordination Provide accurate contact information and promptly communicate updates related to billing, security, and account administration.

5. Payment and subscriptions

Paid plans renew automatically at the end of each billing cycle unless canceled in accordance with the plan terms. You authorize us to charge the payment method on file for recurring fees. Downgrades, upgrades, and cancellations take effect at the next billing cycle unless otherwise stated. Fees are non-refundable except where required by law.

6. Intellectual property

Planning Poker retains all rights, title, and interest in and to the service, including all related intellectual property. You receive a limited, non-exclusive, non-transferable license to access and use the service during your subscription. Feedback you provide may be used to improve the service without obligation to you.

7. Confidentiality

Each party agrees to protect confidential information received from the other and to use it solely for providing or receiving the service. This obligation does not extend to information that is public, already known to the recipient, or independently developed without use of confidential information.

8. Disclaimers

The service is provided on an "as-is" and "as-available" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.

9. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service is limited to the amount you paid for the service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.

10. Indemnification

You agree to indemnify and hold Planning Poker, its affiliates, and their respective officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses arising from your use of the service or violation of these Terms.

11. Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms, create risk or possible legal exposure for us, or fail to pay fees when due. Upon termination, your right to use the service ceases immediately, but sections that by their nature should survive will remain in effect.
